Kuje Residents Drag Area Council Chairman To Court Over Alleged Political Intimidation
By Derick peretengboro
Residents of Kuje Area Council have approached the court over allegations that the council chairman threatened to exclude residents from the community for refusing to support the ruling All Progressives Congress (APC).
The suit has renewed debate over the limits of political authority at the grassroots level and the extent to which elected officials can lawfully use their positions to intimidate residents because of their political affiliations.
The applicants are challenging what they described as an alleged threat to their fundamental rights, including freedom of expression, freedom of association, freedom of movement and residence, as well as protection against discrimination.
According to the applicants, Kuje Area Council belongs to all its residents, irrespective of their political affiliations, and should not be regarded as the exclusive territory of APC members or supporters.
They argued that citizens in a democratic society have the right to freely support political parties of their choice, criticise government policies, associate with opposition groups and participate in political activities without fear of harassment, retaliation or expulsion.
The applicants are therefore asking the court to determine whether the alleged declaration by the council chairman amounted to an unlawful attempt to make residence and participation in community life conditional upon political loyalty.
The case is also expected to test the extent of the powers of elected officials at the local government level, particularly where such powers are allegedly used against citizens who support opposition political parties.
For the applicants, the matter goes beyond individual political differences, raising fundamental questions about democratic freedoms, accountability and the responsibility of public office holders to protect the rights of all residents regardless of their political choices.
The case could have wider implications for political participation and grassroots governance if the court finds that public authority was used to discriminate against or intimidate residents on the basis of their political affiliations.
As of the time of filing the report, the response of the Kuje Area Council Chairman to the allegations contained in the suit was not available.
